Apple’s first figurative trademark application 97495837 was filed under International Class 009 covering the following:

“Downloadable software used to provide retail store services and online retail store services featuring computers, computer hardware and peripherals, computer software, consumer electronics, tablet computers, smartwatches, smartphones, home automation products, set-top boxes, media players, entertainment products, audio speakers, headphones, earphones, wireless routers, computer monitors, computer keyboards, computer mice, computer cables, computer power adapters, carrying cases, computer printers for printing documents and photos, scanners and peripherals, gift cards, and accessories for the foregoing; downloadable computer software for accessing, browsing and searching online databases; downloadable computer software for generating customized product recommendations; downloadable computer software for use in credit card issuance.”

Apple’s second figurative trademark application 97495838 was filed under International Class 035 covering the following:

“Retail store and online retail store services featuring computers, computer hardware and peripherals, computer software, consumer electronics, tablet computers, smartwatches, smartphones, home automation products, set-top boxes, media players, entertainment products, audio speakers, headphones, earphones, wireless routers, computer monitors, computer keyboards, computer mice, computer cables, computer power adapters, carrying cases, computer printers for printing documents and photos, scanners and peripherals, gift cards, and accessories for the foregoing.”

It should be noted that international trademark classes that Apple files their trademarks under are important as the trademark registration will only protect those classes that have been identified in their original application. In a legal battle, the classes filed for originally could make or break a legal case.

The U.S. Patent Office defines a specimen as being an example of how a company is actually using their trademark in the marketplace with the goods or services in their application. It’s what consumers see when they are considering whether to purchase goods or subscribe to services that Apple provides in connection with their trademark.
