Apple Health Defeats Whistleblower’s Rehabilitation Fraud Suit

Apple Health Inc. showed that a False Claims Act whistleblower didn’t adequately allege that the company defrauded Medicare by billing for unnecessary rehabilitation services at nursing facilities, a federal district court said.

Whistleblower Melanie Duhaine didn’t identify any specific claims for Medicare reimbursement, such as the date of any claim or the amount billed, Judge Kara A. Dooley of the US District Court for the District of Connecticut said in a Wednesday decision dismissing the suit with prejudice.

Many allegations were conclusory in nature, premised upon assumptions, or both, the court said.
