Board Will Still Review VLSI Patent Despite OpenSky Misconduct


The validity of a VLSI Technology LLC patent underpinning a multibillion-dollar verdict will still be probed after challenger OpenSky Industries LLC secured an administrative tribunal’s review but attempted to throw the process, an administrative patent tribunal ordered Friday.

The decision to continue with inter partes review of VLSI’s US Patent No. 7,725,759 follows US Patent and Trademark Office Director Kathi Vidal’s conclusion that OpenSky attempted to extract money from both VLSI and Intel Corp. after VLSI won a $2.18 billion patent-infringement verdict against Intel in March 2021.
