Federal antitrust regulators are considering information-gathering changes as companies under their investigation increasingly use third-party messaging apps that automatically delete communications, a Justice Department official said.
The DOJ and Federal Trade Commission have formed a working group to consider changes to the investigative process to counter the problem, Manish Kumar, acting deputy assistant attorney general at the DOJ’s antitrust division, said at a Wednesday conference.
Changes may include using stricter language when seeking information through civil investigative demands, similar to what is now used in grand jury subpoenas, to ensure material is preserved, Kumar said.
