Apple Beats Appeal of Decision Wiping Out $308 Million Verdict
Apple Inc.’s district court win tossing out a $308.5 million patent infringement verdict against it was confirmed Friday by a divided Federal Circuit.
Personalized Media Communications LLC sued Apple for patent infringment in 2015 based on an Apple’s FairPlay software for managing digital rights. After a jury found Apple liable for damages totaling $308.5 million, Judge Rodney Gilstrap of the US District Court for the Eastern District of Texas threw it out, ruling that PMC improperly delayed during the patent application process in such a way that its infringement action unfairly caught Apple by surprise.
