Could 5th Circuit’s Proposed AI Review Certification Deter Use of the Tech?


A federal appeals court’s proposed artificial intelligence review certification rule amendment could end up deterring lawyers from using the technology, legal experts said.

Under the U.S. Court of Appeals for the Fifth Circuit proposal, lawyers would need to check a box confirming no generative AI program was used in drafting the filing, or if one was used, confirm that the citations, legal analysis and any other text “has been reviewed for accuracy and approved by a human.” Certificate of compliance forms are filed publicly on the docket.
