Epic Says Apple Can’t Delay 9th Circ. Args Until 2023
By Matthew Perlman (June 30, 2022, 4:59 PM EDT) — Epic Games has urged the Ninth Circuit to schedule an October date for oral arguments in its dispute over Apple’s app store restrictions, saying Apple’s preference for a date next year should not delay the case.
Epic Games filed an objection with the Ninth Circuit on Wednesday in response to a form submitted by an attorney for Apple indicating that his preparation for an unrelated trial in Nevada federal court and the trial itself will conflict with the Ninth Circuit’s sessions in October, November and December.
