Indiana Doctor Gets Partial Access to Peer Review Records


An Indiana doctor who resigned, rather than be fired, from his hospital practice can access the records of a peer review proceeding because a state privilege law shielding documents from discovery doesn’t apply to him, a federal court in the state said.

The Indiana Peer Review Act makes all peer review committee proceedings confidential, but there is an exception that allows health-care providers to see the records of an investigation into their own practices, the US District Court for the Northern District of Indiana said.
