Supreme Court Asked to Review Nebraska, Minnesota Tax Sale Laws

The U.S. Supreme Court should clarify its precedent to prevent states from confiscating more than they are owed when collecting tax debts, two new petitions for review argue.

The suits specifically allege Nebraska and Minnesota’s tax sale procedures amount to unconstitutional takings without compensation by allowing a taxpayer’s home to be sold to satisfy tax debts without returning the surplus value.

In a petition for review docketed Monday, Kevin Fair alleges his inability to pay a $588.21 property tax bill resulted in the loss of his entire interest in his Scottsbluff, Neb., home worth $60,000.
