Vidal Affirms Board Decision Denying Review of e-Ticket Patent


US Patent and Trademark Office Director Kathi Vidal on Friday affirmed a tribunal’s decision to reject a patent validity challenge for relying too heavily on a conclusory expert witness statement.

The patent—US Patent No. 10,360,567—which is owned by Bytemark, Inc., is for a ticketing system that identifies and blocks users engaged in fraudulent behavior.

Bytemark sued Xerox Corp. in 2017 in the Southern District of New York for allegedly ripping off related patents. After that complaint was amended in 2021 to include the ‘567 patent, Xerox countered by challenging its validity before the Patent Trial and Appeal Board in …
